SRNA, 15.10.2018, Strbac: Indictment against Dudakovic for Crimes against Sebs in The Storm Opperation

BANJALUKA, October 15 /SRNA/ – Head of the Veritas Documentation and Information Centre, Savo Strbac, expects the BiH Prosecutor's Office to issue indictment for command responsibility against war commander of the 5th Corps of the so-called BiH Army, Atif Dudakovic, for war crimes committed against several hundred Serbs during the Storm Operation in 1995.

“We are convinced that an investigation is being conducted against Dudakovic for these crimes and that, in the end, a unique indictment will be composed. Under command responsibility, Atif Dudakovic was a superior to a former member of the 5th Corps of the so-called BiH Army, Sefik Alic, sentenced by the Court of BiH to eight years in prison for war a crime against four captured members of the Srpska Krajina Army,” Strbac told SRNA.

He says that Veritas is seeking compensation for the families of the Serbs killed from Croatia on the basis of the BiH Court’s ruling in Sefik Alic case under the Split Agreement, signed on July 22, 1995 by the then Croatian President Franjo Tudjman and the president of the so-called Republic of BiH, Alija Izetbegovic.

“The request for damage compensation has been forwarded to the State Attorney’s Office of Croatia and we are awaiting their response. In this case, members of the 5th Corps of the so-called BiH Army committed war crimes in the area of the then Srpska Krajina, i.e. Croatia,” says Strbac.

He says that the Veritas filed a criminal charges to the Prosecutor's Office of BiH in Sarajevo against the NN /unnamed person/ for shelling and killing Serb civilians in the refugee convoy on the Petrovac and Prijedor roads, seeking compensation for the families of the killed by BiH and Croatia, referring to the Split Agreement.

“BiH and Croatia are jointly responsible for these crimes, which is why they have to pay damages to the families of the killed Serbs. In this case, Croatian planes entered the territory of BiH and bombed the convoy of Serb refugees from Krajina,” Strbac explains.

He has recalled that during the Storm Operation, the members of the Croatian Army and the 5fth Corps of the so-called BiH Army jointly attacked a convoy of Serb refugees from the Knin Krajina on the Glina-Dvor road and killed more than 200 Serbs and several dozen of Serbs were killed in Pljesevica Mountain.

“There are evidence, witness statements and video material about these crimes. There is no statute of limitation for war crimes in Bosnia and Herzegovina, Serbia and Croatia, including the damage compensations on the basis of war crimes committed,” Strbac has concluded.

The BiH Prosecutor's Office has recently issued an indictment against General Atif Dudakovic and 16 commanders and members of the 5th Corps of the so-called BiH Army for crimes against Serb civilians and prisoners of war in the Krajina region.

In 2014, the third-instance BiH Court Chamber reduced the sentence to former member of the 5th Corps of the so-called BiH Army, Sefik Alic, from ten to eight years in prison for war crimes against four members of the Srpska Krajina Army captured during the Storm Operation on August 5, 1995.

Alic was convicted that he, as a deputy commander of the Hamza battalion within the Fifth Corps of the so-called BiH Army, was involved in the abuse of four captured members of the Srpska Krajina Army in August 1995, and that he did not either prevent or warn, Al Harbi Teufik, an irregular soldier over whom he had an effective control, over maltreatment and killing of prisoners.

He was responsible for the protection of the lives of Mirko Devetak, Petar Stambolija, Pero Borosin and Branko Basic, who were captured during the Storm Operation on August 5, 1995.
